Terms of Service
The master agreement between you and Buseit Internet Private Limited governing your use of the Vingo marketplace.
#1Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Buyer”, or “Seller”) and Buseit Internet Private Limited, a company incorporated under the Companies Act, 2013 (“Company”, “Vingo”, “we”, “us”, “our”), operating the online marketplace under the trademark VINGO (the “Platform”).
By clicking “I Agree”, “Sign Up”, or by accessing or using any part of the Platform — including the Vingo mobile apps (Android and iOS) and website — you represent that you have read, understood, and agree to be bound by these Terms; that you are of legal age (see Section 3); and that you will comply with all applicable Indian laws.
Zero tolerance for objectionable content. You specifically agree that Vingo has no tolerance for objectionable content or abusive users, and that you will not post objectionable content or behave abusively (see Section 10). These Terms incorporate by reference our Privacy Policy, Refund Policy, Shipping Policy, Packaging Policy, Seller Policy, Buyer Policy, and Community Guidelines, all of which form part of this agreement. If you do not agree, you must stop using the Platform immediately.
#2About Vingo
Vingo is a consumer-to-consumer (C2C) online marketplace operated by Buseit Internet Private Limited. The Platform enables registered users to list, buy, bid on, and sell pre-owned and new goods.
Vingo’s role as an intermediary. In accordance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules 2021”), Vingo is an “intermediary” under the Information Technology Act, 2000. Vingo does not own, hold, sell, or resell any goods listed and makes no representations regarding the title, quality, safety, legality, or authenticity of items listed.
Contracts of sale are formed directly between the Buyer and the Seller. Vingo provides the infrastructure, payment facilitation, and logistics coordination services only, and is not a party to any transaction between users.
#3Eligibility
#3.1Age requirement
You must be at least 18 years of age to register and transact on the Platform.
#3.2Legal capacity
You must be legally competent to enter into a binding contract under the Indian Contract Act, 1872.
#3.3Geographic scope
Vingo currently operates exclusively within the territory of India. Cross-border transactions are not supported unless explicitly stated otherwise.
#3.4Business entities
Companies, partnerships, LLPs, and other legal entities may register through an authorised representative who warrants authority to bind the entity to these Terms.
Edge cases — Eligibility
Minor on a parent’s account: the parent/guardian is solely responsible for all activity and transactions.
Non-Resident Indians (NRIs): NRIs with Indian bank accounts and Indian mobile numbers may register; transactions must comply with FEMA regulations.
Previously suspended users: may not re-register under a new identity; violations may result in IP-level blocking and legal action.
#4Account Registration & Security
#4.1Registration
To access the Platform’s full features, you must register with accurate, current, and complete information, including your name, mobile number, and email address. Sign-in uses your mobile number with a one-time password (OTP); Vingo does not use passwords.
#4.2Verification (KYC)
Vingo may require identity verification (Aadhaar-based eKYC, PAN, or other government-issued ID) for sellers, for high-value transactions, or as required by law.
#4.3Account security
You are solely responsible for the confidentiality of your account and device. Do not share your OTP; notify Vingo of any unauthorised use at security@justvingo.com.
#4.4One account per person
Each individual or entity may maintain only one active account. Operating multiple accounts is prohibited and may result in suspension of all associated accounts.
#5User Roles
A single user may act as both Buyer and Seller; the obligations of each role apply independently for each transaction.

#6Listings, Auctions & Bidding
#6.1Seller listings
Sellers are solely responsible for the accuracy and completeness of their listings, including description, photographs, condition grading, price, and known defects. Misleading listings violate these Terms.
#6.2Auctions & bidding
Vingo operates an auction-based marketplace. A bid is a binding offer to purchase at that price if accepted; the highest confirmed bidder at close wins; the second-highest bidder is recorded as the RT2 (Route-to-Second) candidate; and bid retraction after close is not permitted except in exceptional circumstances determined solely by Vingo.
#6.3Soft close (anti-sniping)
A bid placed in the last 3 minutes of an auction extends the auction by 3 minutes.
#6.4Reserve price & Buy Now
Sellers may set a reserve price; if no bid meets it, no transaction forms. Where a “Buy Now” price is offered, purchase at that price is immediate acceptance of a binding offer.
#6.5Reservation window
When you win a bid or choose Buy Now, the item is reserved for you for a limited period during which you must complete checkout. If you do not pay within this window, the reservation lapses, the order is cancelled, and the item may return to the market.
#6.6Communication
Vingo does not provide private buyer–seller messaging. Pre-sale questions are handled through the public question feature, and coordination occurs through the structured offer and order tools, or via Vingo support. You can report any listing or user and block abusive users (see Section 10). Soliciting off-platform contact or payment is prohibited.
#7Transactions, Payments & Refunds
#7.1Formation of contract
A binding contract of sale is formed when a winning bid is confirmed or a “Buy Now” purchase is completed and payment is initiated through the Platform within the applicable reservation window. Vingo’s notification of the transaction constitutes confirmation.
#7.2Payments
All orders are paid in full online through our payment partner, Razorpay. Vingo does not store your card or banking credentials. Vingo currently offers online prepaid payment only — there is no Cash on Delivery and no part-payment/token option.
#7.3Handling of funds & seller payouts
Vingo does not hold your funds directly; all money flows through Razorpay. Following successful delivery, seller payouts are processed by Vingo in accordance with the Seller Policy. Vingo does not operate an escrow service.
#7.4Delivery, inspection & title
Title to the goods transfers from Seller to Buyer on delivery and acceptance. At delivery you may inspect the item (open-box inspection); if you reject it at delivery, it is returned to the Seller and you receive a full refund, as set out in the Refund Policy.
#7.5Cancellations & refunds
Once an order is placed and paid, it cannot be cancelled from the app. Refunds are always for the full amount and are issued to your original payment method through Razorpay in the situations described in the Refund Policy (including where a payment is taken but the order cannot be completed, and open-box rejection at delivery). Vingo does not make partial refunds.
#7.6Taxes
Vingo collects and remits taxes as required by law, including TCS under Section 52 of the CGST Act, 2017 and tax deducted under Section 194-O of the Income-tax Act, 1961, where applicable.
#8Fees & Platform Charges
Vingo may charge fees including listing fees, transaction commissions, promoted-listing fees, and value-added service fees. Current fees are published on the Platform’s Fee Schedule and may be updated with 7 days’ notice. Continued use after notice constitutes acceptance. #9Prohibited Items & Activities
#9.1Prohibited items
- Counterfeit, pirated, or replica goods; stolen or illegally obtained goods;
- Weapons, ammunition, and explosives;
- Narcotics, controlled substances, and prescription drugs without authorisation;
- Live animals, wildlife, or endangered-species products;
- Hazardous, toxic, or radioactive materials;
- Pornographic or obscene material;
- Items infringing third-party intellectual-property rights;
- Human body parts or remains;
- Currencies, securities, or financial instruments;
- Any item prohibited under applicable Indian law.
#9.2Restricted items
Certain categories (e.g., alcohol, electronics, luxury goods) may require additional verification or category approval before listing.
#9.3Prohibited activities
- Creating fake reviews or manipulating the feedback system;
- Circumventing Vingo’s fees by transacting off-platform;
- Sending spam, phishing links, or malicious content;
- Impersonating Vingo employees or other users;
- Scraping or harvesting Platform data;
- Money laundering or financing of prohibited activities.
#10User Conduct & Objectionable Content
ZERO TOLERANCE
Vingo has zero tolerance for objectionable content and abusive users. You agree not to create, upload, post, or transmit objectionable content, and not to behave abusively toward other users or Vingo staff. Breaching this section may result in immediate removal of the content and ejection (permanent ban) of your account.
You must interact honestly, respectfully, and in good faith. You may not harass, threaten, defame, or discriminate against any user on the basis of religion, caste, gender, sexuality, nationality, disability, or any other protected characteristic.
#10.1Objectionable content
“Objectionable content” includes content that is unlawful, obscene, pornographic, harassing, threatening, hateful, discriminatory, violent, defamatory, deceptive, privacy-invasive, spam, malicious, infringing, or otherwise inappropriate for a public marketplace, as further described in the Community Guidelines.
#10.2Reporting and blocking
The app provides tools for every user to report objectionable content or users (via the Report control on any listing or user profile) and to block abusive users. When you block a user, their content is removed from your view immediately, they can no longer interact with you, and Vingo’s Trust & Safety team is notified so it can review the user.
#10.3Our commitment
Vingo filters listings and public content through automated checks and human review, and reviews reports of objectionable content. Where content violates these Terms or the Community Guidelines, Vingo removes the content and ejects the responsible user within 24 hours of a valid report. Vingo may also remove content, restrict features, or suspend accounts as needed to protect the community.
#11Intellectual Property
#11.1Vingo’s IP
The VINGO name, logo, trademarks, and all Platform content (except user-submitted content) are the exclusive property of Buseit Internet Private Limited or its licensors.
#11.2User content licence
By uploading images, descriptions, or other content, you grant Vingo a non-exclusive, royalty-free, worldwide, sublicensable licence to use, reproduce, and display that content for Platform operations, marketing, and promotional purposes.
#11.3Infringement / takedown
Send IP-infringement claims with evidence to support@justvingo.com. Vingo will act promptly in accordance with applicable law.
#12Dispute Resolution
#12.1Between users
Disputes between Buyers and Sellers are reviewed by Vingo’s Customer Mediation Team on the available evidence. Buyers may reject items at delivery (open-box inspection); eligible refunds are issued in full per the Refund Policy.
#12.2Escalation
If in-platform resolution is unsatisfactory, disputes may be escalated to the Grievance Officer (Section 18\) and thereafter to the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or to arbitration.
#12.3Arbitration
For disputes between commercial entities, arbitration shall be conducted under the Arbitration and Conciliation Act, 1996 before a sole arbitrator seated in India. Consumers retain all statutory rights and are not required to arbitrate as a prerequisite to filing consumer complaints.
#13Limitation of Liability
To the maximum extent permitted by law, Vingo’s aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the lesser of (a) the transaction value in dispute, or (b) ₹10,000 (Ten Thousand Rupees).
Vingo is not liable for the quality, authenticity, or legality of items listed by Sellers; force-majeure events; indirect, incidental, or consequential damages; loss of profit or data; or the acts of third-party logistics providers or payment processors. This limitation does not apply where the Consumer Protection Act, 2019 mandates otherwise for individual consumers.
#14Indemnification
You agree to indemnify, defend, and hold harmless Buseit Internet Private Limited, its directors, officers, employees, affiliates, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms or applicable law, or any content you submit.
#15Suspension & Termination
#15.1By Vingo
Vingo may suspend or terminate your account, with or without notice, for violation of these Terms or any policy, suspected fraud, posting objectionable content or abusive behaviour, or any other reason necessary to protect the Platform or its users. On termination, pending transactions are completed or cancelled as appropriate, any amounts due are settled in accordance with the Refund and Seller Policies after review, and eligible refunds are issued in full.
#15.2By you
You may deactivate your account at any time through Platform settings, provided there are no pending transactions, unresolved disputes, or outstanding obligations.
Edge cases — Termination
Reinstatement after suspension: appeal in writing to grievance@justvingo.com; appeals are reviewed within 10 business days, with reinstatement at Vingo’s sole discretion.
Termination by legal order: Vingo may suspend or terminate immediately on a valid court order or law-enforcement direction.
#16Modifications to Terms
Vingo may modify these Terms at any time. Material changes will be notified by email and/or a prominent in-app notice at least 15 days before taking effect. Continued use after the effective date constitutes acceptance.
#17Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of India, including the Indian Contract Act, 1872; the IT Act, 2000; the IT Rules, 2021; the Consumer Protection Act, 2019; the Consumer Protection (E-Commerce) Rules, 2020; the Digital Personal Data Protection Act, 2023; and applicable GST legislation.
Disputes not resolved through Section 12 are subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India. For consumer disputes, the Consumer Protection Act, 2019 and its forum provisions apply.
